Justice Alexandre de Moraes of the Federal Supreme Court (STF) declared this Thursday (24) that Jair Bolsonaro (PL) failed to comply with a court order, but despite this, he denied the former president’s arrest and also stated that there was no ban on the interview.
The decision comes after Bolsonaro’s public address in the Chamber of Deputies, which, according to Moraes, instigated supporters against the STF’s measures.
In the ruling, Moraes acknowledges that the former president failed to comply with the precautionary measures, particularly by replicating Eduardo Bolsonaro’s statements on social media, which would constitute an attempt to obstruct justice. Even so, the justice considers this to be an isolated irregularity and that Bolsonaro had, until then, been complying with the other orders imposed by the court.
“I will no longer convert the precautionary measures into preventive detention,” Moraes wrote. He reinforced that Bolsonaro is not prohibited from giving interviews, but warned that he cannot use this resource to circumvent the social media ban or instigate attacks on Supreme Court justices.
According to the justice, the former president’s strategy appears to follow a defined script to generate coordinated repercussions on social media, which would constitute a violation of Supreme Court rules. Even so, Moraes emphasized that there is no ban on interviews, as long as they are not used as a tool to promote illicit speech or pressure Brazilian authorities.
“As I have emphasized many times during my presidency of the Superior Electoral Court, the courts are blind, but they are not foolish!” the justice stated.
